BART managers and bosses despite being warned that they should not operate trains during a strike by SEIU 1021 and ATU 1555 along with the support of AFSCME 3993 operated trains without properly trained personal and killed two who had crossed the line.

Workers and trade unionists spoke out at the Brown ordered BART inquiry on
August 5, 2013 in Oakland to stop a strike of the BART ATU 1555, AFSCME 3993 and SEIU 1021. BART argued that the workers should take a pay cut to pay for the cost of new trains and equipment. They also refused to answer why they will not bargain over health and safety issues.
